1. Scope

1.1 For all deliveries to consumers (§ 13 BGB) these terms and conditions (GTC) apply.
1.2 A consumer is any natural person who concludes a legal transaction for a purpose which can be attributed neither to their commercial nor to their independent professional activity.

3. Offer & Conclusion of Contract

3.1 The presentation of the products in the online shop does not constitute a legally binding offer, but an invitation to order. Errors excepted.
3.2 By clicking on the order button in the last step of the order process you place a binding order of the goods listed on the order page.
The purchase contract is concluded when we accept your order by an order confirmation by e-mail immediately after receiving your order.

4. Right of Cancellation

4.1 Consumers have a 30-day right of withdrawal.

You can cancel your contract within 30 days without giving any reason in writing (eg letter, fax, e-mail) or – if the case before the deadline – by returning the Revoke the case.
The period begins on receipt of this instruction in text form, but not before receipt of the goods by the consignee (in case of recurring delivery of similar goods not before receipt of the first partial delivery) and
also not before fulfillment of our duties to provide information in accordance with Article 246 § 2 in conjunction with § 1 paragraph 1 and 2 EGBGB and our obligations under § 312g paragraph 1 sentence 1 BGB in conjunction with Article 246 § 3 EGBGB.
To maintain the cancellation period, the timely dispatch of the revocation or the thing is sufficient.

4.3 Consequences of Cancellation

In the case of an effective cancellation, the mutually received benefits and any benefits (eg interest) surrendered.
Can you not or in part or in a deteriorated condition return or surrender the received service and uses (eg benefits of use), or you have to pay us compensation.
For the deterioration of the thing and for benefits drawn, you only have to pay compensation, as far as the use or the deterioration is due to a handling of the thing, which goes beyond checking the properties and functioning.
The term “testing the properties and the mode of operation” refers to the testing and testing of the respective goods, as is possible and customary in a retail store.

Transportable items are to be returned at our risk. You have to bear the regular costs of the return if you have not yet provided the consideration or a contractually agreed partial payment at the time of cancellation or if you do not return from Germany or Austria.
Non-parcels are picked up at your place.
Obligations to reimburse payments must be fulfilled within 30 days. The period begins for you with the sending of your revocation or the thing, for us with their receipt.


4.4 The right of withdrawal does not apply to distance contracts

– for the delivery of goods made to customer specifications or
– clearly tailored to personal needs or
– which by their nature are not suitable for return or
– can spoil quickly or
– whose expiry date would be exceeded,
– for the supply of audio or video recordings or software, provided that the delivered data carriers have been unsealed by the consumer or
– for the delivery of newspapers, periodicals and magazines, unless the consumer has made his contract by telephone.


4.5 Return costs upon exercise of the right of withdrawal

You have to bear the regular costs of the return if you have not yet provided the consideration or a contractually agreed partial payment at the time of cancellation or if you do not return from Germany or Austria.


5. Prices & Shipping Costs

5.1 The prices stated on the product pages include VAT and other price components.

 

6. Shipping

6.1 The delivery takes place within Germany and the specified areas with parcel service providers.
6.2 The delivery time is 1-2 working days. We refer to any deviating delivery times on the respective product page.

7. Payment

7.1 Payment can be made either in advance by bank transfer, Paypal or cash on pickup. In case of a pickup, we ask you to make an appointment in advance by email.
7.2 You are only entitled to set-off if your counterclaims have been legally established by a court or are undisputed or acknowledged in writing by us.
7.3 You can only exercise a right of retention if the claims result from the same contractual relationship.

 

8. Retention of Title

Until full payment, the goods remain our property.
